demand of the proper official, a driver’s license or permit issued under this article that has been suspended, canceled, or revoked as provided by law. (5) Knowingly sell, offer to sell, buy, pos sess, or offer as genuine, a driver’s license or permit required by this article to be issued by the bureau that has not been issued by the bureau under this article or by the appropriate authority of any other state or country. A person that knowingly or intentionally violates this subsection commits a Class C misdemeanor. (b) An individual who: (1) knowingly or intentionally uses a false or fictitious name or gives a false or ficti tious address in an application: (A)for a driver’s license or permit issued under this article; or (B) for a renewal, amendment, or replacement of a driver’s license or permit issued under this article; or (2) knowingly or intentionally makes a false statement or conceals a material fact or otherwise commits a fraud in an appli cation for a driver’s license or permit issued under this article; commits application fraud, a Level 6 felony. 9-24-18-3. Person with custody of motor vehicle permitting unauthorized person to drive. (a) A person that has a motor vehicle in the person’s custody may not cause or knowingly permit an individual to operate the vehicle upon a highway unless the individual holds a valid dri ver’s license or permit under this article for the type of motor vehicle that the individual is oper ating. (b) Aperson that violates this section commits a Class C infraction. 9-24-18-4. Person owning motor vehicle permitting unauthorized person to drive. (a) A person may not authorize or knowingly permit a motor vehicle owned by the person or under the person’s control to be operated by a person who does not have a legal right to do so or in violation of this title.

Operating motor vehicle - never received license; burden of proof. (a) An individual, except an individual exempted under IC 9-24-1-7, who knowingly or intentionally operates a motor vehicle upon a highway and has never received a valid driver’s license commits a Class C misdemeanor. However, the offense is a Class A misdemeanor if the individual has a prior unrelated conviction under this section. (b) In a prosecution under this section, the burden is on the defendant to prove by a prepon derance of the evidence that the defendant: (1) had been issued a driver’s license or permit that was valid; or (2) was operating a motor driven cycle; at the time of the alleged offense. However, it is not a defense under subdivision (2) if the defen dant was operating the motor driven cycle in vio lation of IC 9-21-11-12. 9-24-18-2. Unauthorized possession, display, (a) Aperson may not do any of the following: (1) Display, cause or allow to be displayed, or possess a driver’s license or permit issued under this article knowing that the driver’s license or permit is fictitious or has been canceled, revoked, suspended or altered. (2) Lend to an individual or knowingly permit the use by an individual not entitled to use a driver’s license or permit a driver’s license or permit issued under this article. (3) Display or represent as the individ ual’s driver’s license or permit issued under this article a driver’s license or permit not issued to the individual. (4) Fail or refuse to surrender, upon use, or sale of license or permit; fraudulent procurement of license or permit.
